BLK Luxury Chauffeurs (hereinafter referred to as “BLK”) is a luxury transportation company that facilitates users to book chauffeur services using the website or the app. BLK Luxury Chauffeurs works in coordination with the rules and regulations of the New York Taxi and Limousine Commission (TLC).
These terms and conditions (hereinafter referred to as “Terms”) demonstrate an agreement between Users and BLK Luxury Chauffeurs. These terms describe the services that are offered by BLK.
Please read and adhere to the following terms carefully before using any services that are being offered on the BLK website or BLK mobile application.
No third-party applications are used or affiliated with BLK Luxury Chauffeurs. BLK operates independently as its own entity.
AGE RESTRICTIONSThe minimum age to use our site is 16 years old. By using this site, users agree that they are over 16 years of age. We do not assume any legal responsibility for age related false statements.
RIDE ARRANGEMENTUsers can arrange a ride by completing a booking form on the BLK website or the BLK mobile application. Rides can also be arranged by the telephone. Contact information is available on the website as well as the mobile application.
As soon as a ride is booked by the User, a booking confirmation email will be sent to the mentioned email address.
It is the responsibility of the rider to inform BLK of any changes related to the ride arrangement.
These are the following terms that apply under ride arrangements:The User can either arrange an hourly ride or a ride by distance. If the User chooses to book the services hourly, they will be asked to select the duration of their ride. Additional charges may be added if the duration is changed later on.
If a ride is booked by distance, the User will be charged per mile, surcharges may be applied. This option also gives the User the choice of one-way trip or a round trip.
2. Vehicle ChoiceThe User has the option to choose from various different options when booking a ride. The vehicle images shown on the website and the mobile application are a close representation of what the actual vehicle would look like.
3. Number of guests and luggage per vehicleWhile booking a ride, the booking form states the maximum number of guests and luggage that can be accommodated in the vehicle. The BLK chauffeur has all rights to refuse guests or luggage if it exceeds the limit given on the website. However, a bigger vehicle can be booked for additional charges.
4. Child safety seatsThe User may request a child safety seat when booking a ride at no additional costs.
5. DelaysDelays are inevitable in cases like traffic or extreme weather conditions. Users may have to face last minute cancellations or longer waiting time in such rare but possible scenarios.
6. Cancellation and No-showIn case a User does not show up at the time of the ride without cancellation, the User may be entitled to pay for the ride in full amount.
The service will be fully refunded if a ride is canceled within 60 minutes of being booked.
7. User BehaviorIt is expected that the User behaves in a proper manner, following the seat belt regulations and adhering to the traffic laws. Smoking is prohibited in the vehicle.
It is the responsibility of the User to make sure the vehicle is left in a clean manner. Users may be liable to pay for the cleaning cost of the vehicle if the regulations are not followed.
8. CompensationAll the charges that the User is obligated to pay will be shown when the ride is being booked. This charged will include base fare, estimated surcharges, taxes, and any other additional charges. Price may increase due to additional stops, heavy luggage, or any other special requests.
A booking confirmation email will also depict these charges.
9. SurchargesUser will be charged any surcharge once a ride is completed. Invoice will reflect any surcharges that were applied to the ride.
Surcharge will be applied in instances such as:
Waiting time; user will be charged $1.5 per minute in case the chauffeur is being waited.
Toll; user will be charged toll in accordance with state laws. Toll will be depicted on the invoice after the ride ends.
Parking; user will be charged parking fees if chauffeur needs to pay for parking charges in any case. Parking fees will be depicted on the invoice after the ride ends.
Peak hour surcharges; user will be surcharged if services are used between 6 am to 10 am and between 4 pm to 8 pm on Monday-Friday, 4pm to 12 am on Saturday and 12 am to 10 pm on Sunday.
Special circumstances; user will be surcharged if services used during U.S. National holidays. User will also be surcharged if services are used during bad weather conditions such as heavy run, snow, hailstorm, etc.
Gratuity; user will be charged 20% gratuity towards the chauffeur. This would be depicted on the invoice after the ride ends.
Credit/Debit charges; user will be charged 5% on every credit or debit card Payment. This will be reflected on the invoice after the ride ends.
Meet & greet; If a user requests a driver for a greeter to receive them inside of a terminal, meet and greet charges will be applicable and reflected on the invoice after the ride ends. Price will vary depending on the waiting time.
CONSUMER PROTECTION LAWWhere any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
LIMITATION OF LIABILITYBLK Luxury Services and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site.
INDEMNITYExcept where prohibited by law, by using this Site you indemnify and hold harmless BLK Luxury Services and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
APPLICABLE LAWThese Terms and Conditions are governed by the laws of the State of New York.
CHANGESThese terms and conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our site and the way we expect users to behave on our site. We will notify users by email of changes to these terms and conditions or post a notice on our website.
SEVERABILITYIf at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
